EVISIT.LV TERMS OF SERVICE


1. General terms of service
1.1 The Evisit website www.evisit.lv (henceforth – Evisit) is a digital platform of information and continuing medical education for persons involved in the healthcare sector, who have registered on the Evisit system.
1.2 The Evisit terms of service define the conditions and limitations of the available website services and apply to all the users.
1.3 The operation of the website is organised, maintained and coordinated by limited liability company Evisit (reg. Nr. 40003507486, the legal address: Zolitūdes 54, Riga, LV-1029; henceforth SIA Evisit). To ensure that the website is operating according to its purposes SIA Evisit is processing and keeping records of the submitted personal data.
1.4 By using the website, each user completely agrees to these terms of service, including all the changes made to them. Evisit users are responsible for reading and complying with the Evisit terms of service, as well as rereading these terms regularly to get the information about the changes in a timely manner.
1.5 Only persons, who are involved in the healthcare sector, medical students and SIA Evisit partners are allowed to register on the website. Upon receiving a registration request, SIA Evisit has the right to check, whether the person is listed in the respective registers. For submitting false information, the person shall be excluded from the data base of the registered Evisit website users and may be held accountable according to the laws and regulations of the Republic of Latvia.
2. Services available on the Evisit website
2.1 Evisit offers the users an opportunity to:
2.1.1 Learn the lectures (henceforth – lecture) accepted by Latvian Medical Association, Pharmacists' Society of Latvia, Latvian Nurses Association and/or other societies;
2.1.2 Receive a certificate , which acknowledges continuing medical education points received for completing watching a lecture and answering correctly to the lecturer's control questions;
2.1.3 Ask questions to the lecturers and receive answers to the questions, by sending them to the e-mail address info@evisit.lv;
2.1.4 To download the reference materials prepared by the lecturer, if such are provided;
2.1.5 To get acquainted with informative materials about medications;
2.1.6. To purchase an access to the charged lectures and courses with a bank card.
2.2 The range of services is expanded regularly.
2.3 The certificate or proof of completion is available for printing for 6 years since the moment it has been received.
2.4 The user is allowed to use the lecture reference materials only for personal educational needs. Any other use of the reference material is strictly forbidden.
3. Advertising concept of the website
3.1 The administration of Evisit has the right to grant access to particular lectures only after the user has watched an informative material about medications (advertisement).
3.2 If a particular advertising or informative material is attached to a lecture, it does not mean that this lecture is ordered and paid by the respective advertiser.
3.3 If a lecture is ordered and paid by a particular company (sponsor), the fact of sponsoring is indicated.
3.4 The advertiser or merchant in whose interests the advertisement or other submitted material is posted is the one who is responsible for the content of the respective material and its compliance with the laws and regulations of the Republic of Latvia. The opinion of Evisit does not always match with that of the author of the material. As to the posting of advertising materials on the Evisit website, Evisit is responsible only with the technical side of placing the material according to the submitter's desires.
4. Creation and deletion of an Evisit user's account
4.1 To become a registered Evisit user, one must complete the registration form. Upon discovery of illegalities, when a user is using someone else's personal data, the Evisit administration has the right to delete the user's account and inform the authorities about the potential violations of law.
4.2 The user undertakes not to disclose his Evisit access data to other persons.
4.3 The user undertakes to immediately inform Evisit about any unauthorised use of password or any other violation of the security rules. At the end of each log-in session, the user needs to ensure that he has logged out (by pressing the respective button instead of just closing the browser). Evisit is not responsible for any losses or expenses due to the user actions that do not comply with the terms of service of the website.
4.4 All the registered personal data and correspondence of the Evisit users is being protected according to the laws and regulations of the Republic of Latvia.
4.5 According to the Personal Data Protection Law Paragraph 7 Point 1 and 2 and Paragraph 13.1, when registering on the Evisit website, the user consents to and authorises the processing of his personal data by SIA Evisit as the supervisor of the personal data for the following purposes: to ensure keeping the records of the healthcare professionals and allied health professionals, who have registered on the Evisit website, and of their certificates, including those obtained by using services on the Evisit website, as well as to ensure customised offers for the Evisit users.
4.6 The Evisit user agrees that the processing of his personal data performed by SIA Evisit includes any actions associated with collecting, recording, entering, storing, organising, formatting, using, transferring, blocking or deleting the data. The Evisit user's personal data – name, surname, date of birth and other – are used exclusively for the purposes of preparing certificates and verifying that the registered person is involved in the healthcare industry, if necessary.
4.7 Evisit can send information about what is new on the Evisit website to the e-mail address or telephone number that the user has indicated, including the information from collaboration partners. If the user no longer wishes to receive additional information, he can unsubscribe from it, by notifying SIA Evisit.
4.8 The Evisit user's personal data – name, surname, birth data or personal identity number, as well as the information about the certificates acquired on the Evisit website – shall not be disclosed to third parties without the user's consent also after the termination of the relationship, except for the cases defined by the laws and regulations of the Republic of Latvia, if the data are requested by the national supervisory bodies.
4.9. By agreeing to the terms of service of this website, the Evisit user is aware and agrees that upon the request of Latvian Medical Association, Pharmacists' Society of Latvia, Latvian Nurses Association and/or other professional medical societies or when required for medical training, SIA Evisit has the right to transfer the data at its disposal to the recertification commissions for the verification of the issued certificates.
4.10 If the user has signed up for and/or attended an event, in which SIA Evisit has been registering and/or issuing digital certificates, the user agrees that his personal data related to this event will be transferred to the organisers of the event.
4.11 If the user has forgotten his password, he should submit a request about resetting the password to the Evisit administration, by pressing "Forgot password?" in the log-in screen of the website. The new password will be sent to the e-mail address indicated in the user's registration form.
4.12 If the user does not agree to the terms of service of the Evisit website and does not wish to use the Evisit services further, he can refuse from his account, by sending a request to the Evisit administration via e-mail to info@evisit.lv or on the section "Contacts" of the Evisit website. After the respective request to delete the user's account has been received, all the user's personal data will be deleted from the data base within one working day. In the case, if the respective user has used the Evisit website services and has received a confirmation of finishing and learning a lecture, then, after the user's account has been deleted, such information shall be stored no longer than 5 (five) years after the respective service has been received.
4.13 Evisit has a right to delete a user's account, if the user has not entered complete or accurate information requested in the registration form or has registered more than once, using different data. In such case, before deleting the user's account, the user will be notified via e-mail about the problem and will receive suggestions on how to solve it. If the user does not reply to the e-mail message within two working days, the user's account and all his personal data will be deleted. In case the user has registered more than once, all the accounts will be deleted. After the data have been erased, the user can register again, by entering complete and correct information requested in the registration form.
4.14 The Evisit administration has the right to delete the user's account without his consent, if the user does not follow or violates the Evisit terms of service. In such case, all the user's personal data will be erased.
4.15 According to the Personal Data Protection Law, the system user as a data subject has a free access to the personal data processed by the system, using his Evisit profile.
4.16 Every user is responsible for ensuring that his data are accurate. When the contact details, profession or other data change, they shall be immediately changed or Evisit shall be informed about it. In case of inaccurate information, the certification commission might not review the application and might confirm the CME points acquired.

5. Copyright and related rights
5.1 All intellectual property rights associated with the Evisit website belong exclusively to SIA Evisit. In the case these rights have been violated, the violator shall be held accountable according to the laws and regulations of the Republic of Latvia and fully responsible for all the losses SIA Evisit has suffered as a result.
5.2 The intellectual property items posted on the website are protected under the Copyright Law and other laws and regulations of the Republic of Latvia. Any use of the intellectual property items posted on the Evisit website is authorised only by a written permission from the Evisit administration and according to these terms of service.
6. Terms of access to the charged lectures
6.1. The charged lectures are available only to the registered users, who have registered on the Evisit website and paid for them with a bank card in the Evisit system. The access to the charged study materials can be purchased on-line with following international cards issued by any bank: MasterCard, VISA, VISA Electron and Maestro).
6.2. The user may use the service Mans maks for making a transfer from this website.
6.3. If a user has been denied or restricted his access to Evisit or if his profile or profile information have been deleted, then this Evisit user will not receive any refunds for his losses or payments for the used Evisit services.
6.2. After the set amount has been paid, the lecture is available to the user immediately. The length of a lecture is indicated at each lecture.
7. Other rules
7.1 SIA Evisit has the right to use the contact details stored on Evisit website and send SMS (mobile phone) messages, e-mail or mail letters to notify the users about various current events associated with the website.
7.2 In order to receive a certificate/ proof of completion, the Evisit website user is responsible to learn the study material before submitting the answers to the control questions.
7.3 SIA Evisit is recording the activities performed on the Evisit website.
7.4 All the disputes arising in regards to these terms between SIA Evisit and the website users shall be settled through mutual discussions. In the case the disputes are not settled through discussions, they shall be settled according to the procedure defined by the laws and regulations of the Republic of Latvia.
7.5 The author of a specific material published on the Evisit website is responsible for its content and that it complies with the laws and regulations of the Republic of Latvia.
7.6 SIA Evisit reserve the right to change the Evisit terms of service and such changes shall come into force 10 days after they have been approved. When the changes have been approved, the users are notified via e-mail, using the e-mail addresses registered in the Evisit system.
